1. Introduction

These terms and conditions outline your use of Aircon Rescue Inc services. By using our services, you accept these terms and conditions in full. 

2. Money-Back Satisfaction Guarantee

2.1 Satisfaction Guarantee: At Aircon Rescue Inc, we stand by the quality of our products and services. If you are not satisfied with the installation while the technician is still at your home, you may request the panel to be removed.

2.2 Immediate Refund: If you express dissatisfaction with the installation while the technician is still at your home and we are not able to resolve your concerns, we will remove the installed panel and provide you with a full refund within 2-7 business days.

2.3 Conditions: This guarantee applies only if the dissatisfaction is expressed while the technician is still at your home, and the removal is requested during the technician’s initial visit for the installation. Once the technician leaves the home, the installation will be considered accepted, and the money-back guarantee will no longer apply. This guarantee applies only to quotes issued from June 1st, 2024, onwards.

3. Limitation of Liability

3.1 General: Aircon Rescue Inc will not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services.

3.2 Service Disruption: We are not responsible for any delays or interruptions in service due to unforeseen circumstances, including but not limited to natural disasters, strikes, or equipment failure.

4. Pricing

4.1 Pricing: Our service prices are listed on our website and may vary based on the type and complexity of the service. Prices are subject to change without notice. Any Promotions Aircon Rescue Inc. runs that are past the date of payment will not be applied to the past invoice.

5. Changes to Terms and Conditions

5.1 Right to change: Aircon Rescue Inc reserves the right to update or modify these terms and conditions at any time without prior notice. Any changes will be posted on our website. Continued use of our services after any such changes constitutes your acceptance of the new terms and conditions.

6. Discounted Invoices

6.1 Payment Terms for Discounted Invoices: If the discounted invoice is not paid within the 30-day period, the discount will be voided, and you will be required to pay the full price for the services rendered.

7. Quotes and Discount Expiration

7.1 Validity of Quotes: All quotes provided by Aircon Rescue Inc are valid for a period of 30 days from the date the quote was made.

7.2 Discounts on Quotes: If a quote includes a discount, the discount is valid only within the 30-day quote period.

7.3 Expiration of Discounts: If the quote is not accepted and the service is not scheduled within the 30-day period, the discount will no longer qualify, and a new quote will be required at the current full price.

8. Intellectual Property Rights

8.1 Service Content, Software, and Trademarks: You acknowledge and agree that Aircon Rescue Inc services may contain content or features (“Service Content”) that are protected by copyright, patent, trademark, trade secret, or other proprietary rights and laws. Except as expressly authorized by Aircon Rescue Inc, you agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute, or create derivative works based on the Service or the Service Content, in whole or in part. This restriction does not apply to your own User Content that you legally upload to the Service.

The technology and software underlying the Service or distributed in connection therewith are the property of Aircon Rescue Inc, our affiliates, and our partners (the “Software”). You agree not to copy, modify, create a derivative work of, reverse engineer, reverse assemble, or otherwise attempt to discover any source code, sell, assign, sublicense, or otherwise transfer any right in the Software. Any rights not expressly granted herein are reserved by Aircon Rescue inc.

9. Use of Photos

9.1 Permission to Use Photos: By using our services, you grant Aircon Rescue Inc permission to take and use photographs of the installed window products for marketing, promotional, and demonstration purposes. These photos will not include any personal information. Please advise in advance if you prefer these photos to be used.

9.1 Anonymity and Privacy: Aircon Rescue Inc will ensure that no personal information or identifying features are visible in the photos used. The focus will be solely on the window product and its installation.

9.2 Request for Removal: If you wish to have a photo of your home removed from our materials, you must submit a written request to Aircon Rescue Inc. 

10. Limitation of Liability

10.1 Post-Installation Liability: Aircon Rescue Inc is not responsible or liable for any injuries, damages, or losses that occur after the installation of the window panels is completed and accepted by the customer. This includes, but is not limited to, injuries or damages resulting from improper use, accidents, or unauthorized modifications.

10.2 Customer Responsibility: It is the customer’s responsibility to ensure that the window panels are used and maintained properly in accordance with the provided guidelines and instructions.

10.3 Indemnification: By using our services, you agree to indemnify and hold Aircon Rescue Inc harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the window panels, any breach of these terms, or any violation of applicable laws.
